These terms apply to your use of roseatecharters.com and to enquiries you make with Roseate Charters ("Roseate Charters", "we", "us"). By using the site you agree to them.
What we do
Roseate Charters arranges private aircraft charters on your behalf. We do not own or operate aircraft. Every flight is operated by an aircraft operator holding the licences required for that flight, such as a Non-Scheduled Operator Permit issued by the Directorate General of Civil Aviation (DGCA) in India, or the equivalent approvals for a foreign operator.
The operator has full operational control of the flight. The operator and the pilot in command decide on matters of safety, including weather, aircraft serviceability, crew duty limits, payload and whether a flight can depart or land as planned. Their decision is final.
Information on this website
- Flight times, distances, aircraft suggestions and ranges shown on the site, including in the route planner, are estimates for guidance only.
- Aircraft photographs and cabin layouts are representative of a type. The aircraft offered for your flight may differ in livery, interior and configuration.
- Aircraft availability changes constantly. Nothing on the site is an offer to fly a particular aircraft on a particular date.
Quotes and bookings
- A quote is valid for the period stated on it and is subject to aircraft availability, operator confirmation, regulatory approvals and slots at the time you confirm.
- A booking is confirmed only when you have accepted our written charter confirmation or agreement and we have received the payment it specifies.
- Prices are in Indian rupees and exclude GST and other applicable taxes unless stated otherwise. Changes in airport, navigation, handling, permit or fuel charges, de-icing, extra waiting time or changes to your itinerary may be charged in addition, as set out in your confirmation.
- Payment, cancellation, change and refund terms are those set out in your charter confirmation or agreement. If they differ from anything on this website, the confirmation or agreement applies.
Rose Atelier membership
The membership pages give a summary of Rose Atelier. Membership is by invitation and is governed by a separate written membership agreement, which sets out the flying hours, what is included, how hours are used and expire, international flying, payment and all other terms. If anything on the website differs from the agreement, the agreement applies. Membership prices exclude GST.
Empty legs
Empty legs depend on another charter. If that charter changes or is cancelled, the empty leg may be re-timed or withdrawn. Terms for each empty leg are given when it is offered.
Air ambulance
Our air ambulance service arranges planned and urgent transfers between hospitals. It does not replace emergency services. In a life-threatening emergency, call 112 or your local emergency number first. Every transfer is subject to a medical assessment by the flight medical team, the patient being fit to fly, and confirmation from the receiving hospital.
Passengers
- Passengers must carry valid identity and travel documents, including passports and visas for international flights.
- Dangerous goods and items restricted by aviation security rules may not be carried. Firearms, pets and unusual baggage must be declared in advance.
- The operator may refuse to carry any passenger who is unfit to fly, whose conduct endangers the flight, or who does not meet security or document requirements.
Liability
Carriage by air is provided by the operator and is subject to the operator's conditions of carriage and applicable law, including the Carriage by Air Act, 1972. To the extent permitted by law, Roseate Charters is responsible only for arranging the services we agree to arrange with reasonable care and skill, and is not liable for the acts or omissions of operators, airports, authorities or other third parties, or for delays and cancellations caused by weather, air traffic control, regulatory action, technical issues or other events outside our reasonable control. Nothing in these terms limits any liability that cannot be limited by law.
Use of the website
The content, design, logo and brand names on this site, including Roseate Charters and Rose Atelier, belong to us or our licensors. You may view and share pages for personal use, but may not copy, reproduce or use them commercially without our written permission. Links to other websites are provided for convenience; we are not responsible for their content.
Privacy
How we handle personal data is explained in our privacy policy.
Governing law
These terms are governed by the laws of India. The courts at New Delhi have exclusive jurisdiction over any dispute arising from them.
